On August 25, NIH appeared in conference in federal court in the District of New Jersey. The purpose of the appearance was for resolution of Jin-Pyong Peter Yim v National Institutes of Health and for scheduling of “motion practice”, if necessary. I am the plaintiff in the case. Beneath the legal formalities, the case could reveal that NIH deceived the nation on a treatment for COVID-19.
NIH is alleged to have violated the Freedom of Information Act. NIH failed to respond to a document request made on January 28, 2021:
“All updates to the Coronavirus Disease 2019 (COVID-19) Treatment Guidelines that were endorsed by a vote of the Panel. (Date Range for Record Search: From 01/01/2021 To 01/28/2021)”
The purpose of the FOIA request was not to obtain the document. Rather, it was to know if a vote was held to endorse the NIH recommendation on ivermectin. NIH violated FOIA because it did not respond within the time defined by statute. A complaint was filed against the NIH on March 26, 2021 to appeal the non-response. NIH answered the complaint on June 30. The answer included an exhibit and testimony.
NIH was represented by Margaret Ann Mahoney. She stated that NIH had responded to the FOIA request. She was referring to the NIH FOIA response from April 23:
“You requested all updates to the Coronavirus Disease 2019 (COVID-19) Treatment Guidelines that were endorsed by a vote of the Panel (Date range for record search from 01/01/2021 to 01/28/2021). All approved updates to the guidelines are posted online and can be found here. The documents posted on this website respond to your request in full.”
I requested a change to the NIH response. The NIH response is ambiguous as to whether the requested document exists. I provided a URL that refers to a single document. I requested that that URL be given in the NIH FOIA response if that recommendation was endorsed by a vote.
The conference was presided over by Judge Lois H. Goodman. She gave her opinion following discussion between the plaintiff and defendant. She expressed skepticism of the legal basis for the complaint. However, she urged further negotiation and allowed for “motion practice” if no agreement was reached. Her concluding remarks are here.
Following the conference, Judge Goodman also issued the following order:
“TEXT ORDER directing parties to confer to attempt resolution to this dispute. Parties to report to the Court as to the results of those efforts to resolve by 9/8/2021. If, matter cannot be resolved, dispositive motions to be filed by 9/24/2021 and to be returnable on 10/18/2021. Ms. Mahoney is directed to provide pro se plaintiff with a copy of this text order. So Ordered by Magistrate Judge Lois H. Goodman on 8/26/2021 .”

Texas Attorney General Ken Paxton called for prosecution over a sexually explicit drag performance in front of at least one young child in exclusive comments to the Daily Caller News Foundation.
A drag performer sang sexually explicit lyrics, simulated a sex act and flashed underwear in front of children at an “all ages” event Saturday in Plano, Texas. It’s the responsibility of district and county attorneys to prosecute the “inappropriate acts” on display at the drag show, according to Paxton, who called on the state’s legislature to add language to the penal code explicitly addressing this issue.
“This is grotesque, disturbing behavior. Under Texas law, local district and county attorneys are charged with taking up the mantle to protect Texas kids by prosecuting these types of totally inappropriate acts,” Paxton told the DCNF.

Special Counsel John Durham made a calculated decision to transform his only criminal trials — of Clinton lawyer Michael Sussmann and Steele dossier source Igor Danchenko — into forums for telling the story of the FBI’s pursuit of the unsubstantiated Russia collusion narrative.
From pretrial motions and brutal cross-examinations of FBI witnesses to his parting words at the Danchenko trial, Durham telegraphed his disdain for the FBI’s behavior to jurors in the courts of both law and public opinion.
The jury might very well conclude the FBI mishandled the Russia case, the veteran prosecutor declared Monday in his closing argument. “The government is not here to defend the FBI’s performance in these matters,” he added. Such comments gave license to jurors to acquit, as they did in the end.

Following the announcement today General Michael Flynn, whose life was ruined by the lies and corruption of the Department of Justice, responded to the jury verdict.

Steele dossier source, paid FBI informant, Igor Danchenko acquitted | BizPac Review

A federal jury on Tuesday found Igor Danchenko, a key source of information for the infamous Steele dossier, not guilty of making false statements to the FBI.
Danchenko was found guilty of making false statements to the bureau, the outlet reported, on four occasions in 2017 related to sources of information he gave former British spy Christopher Steele’s Orbis Business Solutions. The Steele dossier, which was later discredited, also served as a major foundation for FBI Foreign Intelligence Surveillance Act (FISA) warrant applications against former Trump campaign aide Carter Page.
The dossier included claims that Trump’s campaign conspired with Russia, which allegedly blackmailed Trump with footage of him and prostitutes at a Moscow hotel.
District Judge Anthony Trenga dismissed one of the five federal charges against Danchenko Friday, deeming Danchenko’s claim to the FBI that he discussed particular dossier content with former Democratic operative Charles Dolan “literally true,” according to CNN. Dolan testified the previous day that he sent Danchenko content from cable news but falsely told him of a meeting with a “GOP friend.”
Dolan, a former advisor to both Bill and Hillary Clinton who served in the latter’s 2016 presidential campaign, was a source for at least one claim in the Steele dossier.
Steele and his company were paid by the U.S. firm Fusion GPS, which attorneys for Democrats hired to probe Trump, according to CBS News. Earlier this year, the Democratic National Committee and Hillary Clinton’s 2016 presidential campaign agreed to pay $130,000 in a settlement to end a Federal Election Commission probe into whether they misreported funding for research that resulted in the Steele dossier, violating campaign finance law, The Associated Press reported.
Danchenko was a paid source for the FBI from March 2017 to 2020, a court document previously showed. FBI supervisory analyst Brian Auten testified last week during Danchenko’s trial that Steele failed to prove claims in the dossier during an October 2016 meeting in exchange for a $1 million dollar FBI offer, CNN reported.
The FBI and an attorney for Danchenko did not immediately respond to the Daily Caller News Foundation’s request for comment.

The Pentagon’s diversity, equity and inclusion chief for the agency’s education programs reportedly recommended for children to read a book calling 9/11 first responders “menaces.”
Kelisa Wing, who leads diversity activities at the Defense Department’s education wing and is currently under review for anti-white comments, recommended in 2018 for classrooms to use the book “Between the World and Me,” Fox News reported Monday.
“They were not human to me. Black, white, or whatever, they were menaces of nature; they were the fire, the comet, the storm, which could — with no justification — shatter my body,” Ta-Nehisi Coates wrote in his anti-police book, “Between the World and Me.”
The Pentagon was targeted in the Sept. 11, 2001, terrorist attacks and 184 people were killed there.
As a teacher, Wing listed “Between the World and Me” on a “Social Justice Book List” in a 2018 article for “Digital Promise,” an Obama-era organization that focuses on innovation in education.
“Your classroom materials should be a mirror for your students in which they can see themselves represented,” Wing said in the article.

Oh. Oh. The Establishment Pivots Again To Russian Collusion Ahead Of The Mid-Term Election | “Fiona Hill says Musk tweet ‘clearly is a message from Putin'” | The Hill
Fiona Hill, a Russia expert who served on the National Security Council under former President Trump, said billionaire Elon Musk was “transmitting a message” for Russian President Vladimir Putin when he tweeted out a proposal to end the war earlier this month.
Hill told Politico in an interview published Monday that before Musk tweeted out his so-called peace proposal earlier this month, he made a similar statement at a September event in Aspen, Colo., suggesting the Crimean Peninsula remain in Russian hands.
Musk also said then that control over the Kherson and Zaporizhzhia regions should be negotiated because Crimea would need water supplies from those regions, Hill noted.
“The reference to water is so specific that this clearly is a message from Putin,” she said.
Hill served as senior director for European and Russian affairs on the National Security Council from 2017 to 2019 and is now a senior fellow at Brookings.
She explained to Politico that Putin “often uses various trusted intermediaries including all kinds of businesspeople.”
“I had intermediaries sent to discuss things with me while I was in government,” she told Politico. “This is a classic Putin play. It’s just fascinating, of course, that it’s Elon Musk in this instance, because obviously Elon Musk has a huge Twitter following.”
Earlier this month, Musk tweeted out a poll asking his more than 100 million followers to weigh in on his peace proposal, which drew the rebuke of Ukrainian officials and U.S. lawmakers after the billionaire suggested Ukraine give up the Crimean Peninsula, which Russia illegally annexed in 2014.
He also suggested new elections be held under United Nations supervision in four recently annexed eastern regions: Luhansk, Donetsk, Kherson and Zaporizhzhia.
Ukraine has vowed to reclaim all of the illegally annexed territory.
Musk’s poll ended with 59 percent of users against and 40 percent in support with more than 2 million respondents.
Ian Bremmer, the president and founder of political consulting firm Eurasia Group, said last week that Musk told him he had spoken to Putin and knew what Russia’s red lines were. Musk replied that “nobody should trust Bremmer.”
“I have spoken to Putin only once and that was about 18 months ago. The subject matter was space,” Musk said in another tweet.
Last week, CNN reported that Musk has been floating the peace proposal at conferences for weeks, citing sources familiar with the matter, who also alleged Musk may have been in contact with the Kremlin.
The SpaceX and Tesla CEO also drew headlines last week when he threatened to pull his Starlink satellites, which are providing internet service to embattled Ukraine, out of the country because of the high cost. Musk later backed off from the idea and is reportedly discussing ongoing funding with the Pentagon.
Hill argued that Musk is merely a pawn in Putin’s game, noting that the billionaire is extremely popular in Russia.
“He’s got a longstanding reputation in Russia through Tesla, the SpaceX space programs and also through Starlink. He’s one of the most popular men in opinion polls in Russia,” she said.
“Putin plays the egos of big men, gives them a sense that they can play a role. But in reality, they’re just direct transmitters of messages from Vladimir Putin,” she added.

Many people wonder where the idea came from that George Floyd actually overdosed while being restrained by police. It was from the toxicology report that showed the level of fentanyl in George Floyd’s blood was 5 times the normal lethal dose, as described by the DEA.
“Two milligrams of fentanyl can be lethal depending on a person’s body size, tolerance and past usage. DEA analysis has found counterfeit pills ranging from .02 to 5.1 milligrams (more than twice the lethal dose) of fentanyl per tablet”.

Forensic pathologist Dr. Lindsey Thomas testified Friday at the trial of former Minneapolis, Minnesota, police officer Derek Chauvin that absent a struggle with police, the death of a person with the drugs George Floyd had in his system would have been ruled an overdose.
Defense attorney Eric Nelson cross-examined Thomas, a witness for the prosecution, after she had testified that the “primary mechanism of death” in the case was “asphyxia or low oxygen.”
Nelson was careful to ask about the level of drugs, because prosecutors have suggested the levels in Floyd’s body were low.
Nelson: So again, just kind of taking into consideration, removing certain variables, right, you find a person at home, no struggle with the police, right, and the person doesn’t have a heart problem, yet you find fentanyl and methamphetamine in this person’s system at the levels they are, would you certify this as an overdose ?
Dr. Thomas: Again, in the absence of any of these other realities, yes, I could consider that to be an overdose.
Nelson: And the level of fentanyl in a person — again, in this hypothetical scenario — there are deaths certified as drug overdoses significantly lower than 11 nanograms per milliliter ?
Dr. Thomas: Lower, higher. it’s got a huge range, yes.
Nelson: As low, I believe, as three percent or three nanograms per milliliter?
Dr. Thomas: Yes.
Nelson: So the ingestion of drugs is unique to that individual’s body, right?
Dr. Thomas: Right.
Nelson: I have no further questions.
Other experts have testified for the prosecution that Floyd died from a lack of oxygen caused by Chauvin kneeling on his neck.
But the prosecution has shifted its theory from arguing that Chauvin cut off the flow of blood in Floyd’s arteries, and began referring to a knee placed on Floyd’s “neck area” rather than the neck itself, following earlier cross-examinations.

George Floyd’s family has said it may sue Kanye West for suggesting Floyd’s brutal, caught-on-camera death under the knee of a murderous Minnesota cop was really a fentanyl overdose.
“While one cannot defame the dead, the family of George Floyd is considering suit for Kanye’s false statements about the manner of his death,” their attorney, Lee Merritt, confirmed late Sunday.
“Claiming Floyd died from fentanyl not the brutality established criminally and civilly undermines and diminishes the Floyd family’s fight.”

Merritt said that “members of the Floyd family contacted me distraught over the reprehensible remarks” that Kanye shared in an hours-long interview on the “Drink Champs” podcast Sunday.
During that boozy chat, West — now using the name Ye — said he was inspired by watching “The Greatest Lie Ever Sold,” the documentary about Black Lives Matter by Candace Owens, whom the rapper modeled his controversial “White Lives Matter” T-shirts with.

Forecast for US Recession Within Year Hits 100% in Blow to Biden | Bloomberg
A US recession is effectively certain in the next 12 months in new Bloomberg Economics model projections, a blow to President Joe Biden’s economic messaging ahead of the November midterms.
The latest recession probability models by Bloomberg economists Anna Wong and Eliza Winger forecast a higher recession probability across all timeframes, with the 12-month estimate of a downturn by October 2023 hitting 100%, up from 65% for the comparable period in the previous update.
The forecast will be unwelcome news for Biden, who has repeatedly said the US will avoid a recession and that any downturn would be “very slight,” as he seeks to reassure Americans the economy is on solid footing under his administration.
But tightening financial conditions, persistent inflation and expectations of a hawkish Federal Reserve pressing ahead with rate hikes are raising the risk of a contraction.
The model is more certain of a recession than other forecasts. A separate Bloomberg survey of 42 economists predicts the probability of a recession over the next 12 months now stands at 60%, up from 50% a month earlier.

VAERS data released Friday by the Centers for Disease Control and Prevention show 1,437,273 reports of adverse events from all age groups following COVID-19 vaccines, including 31,470 deaths and 261,738 serious injuries between Dec. 14, 2020, and Oct. 7, 2022.

The Centers for Disease Control and Prevention (CDC) today released new data showing a total of 1,437,273 reports of adverse events following COVID-19 vaccines were submitted between Dec. 14, 2020, and Oct. 7, 2022, to the Vaccine Adverse Event Reporting System (VAERS).
VAERS is the primary government-funded system for reporting adverse vaccine reactions in the U.S.
The data included a total of 31,470 reports of deaths and 261,738 serious injuries, including deaths, during the same time period.
There were a total of 3,232 reports of adverse events following the new bivalent booster COVID-19 vaccine as of Oct. 7, 2022. The data included a total of 26 deaths and 162 serious injuries.
Of the 31,470 reported deaths, 20,125 cases are attributed to Pfizer’s COVID-19 vaccine, 8,533 cases to Moderna, 2,735 cases to Johnson & Johnson (J&J) and no cases yet reported for Novavax.
Excluding “foreign reports” to VAERS, 880,882 adverse events, including 14,790 deaths and 91,760 serious injuries, were reported in the U.S. between Dec. 14, 2020, and Oct. 7, 2022.
Foreign reports are reports foreign subsidiaries send to U.S. vaccine manufacturers. Under U.S. Food and Drug Administration (FDA) regulations, if a manufacturer is notified of a foreign case report that describes an event that is both serious and does not appear on the product’s labeling, the manufacturer is required to submit the report to VAERS.
Of the 14,790 deaths reported as of Oct. 7, 7% occurred within 24 hours of vaccination and 15% occurred within 48 hours of vaccination.
In the U.S., 619 million COVID-19 vaccine doses had been administered as of Oct. 6, including 370 million doses of Pfizer, 234 million doses of Moderna and 19 million doses of J&J.

Every Friday, VAERS publishes vaccine injury reports received as of a specified date. Reports submitted to VAERS require further investigation before a causal relationship can be confirmed.
Historically, VAERS has been shown to report only 1% of actual vaccine adverse events.
